PersonalHour Purchasing Agreement

PersonalHour® Purchasing Agreement

This Purchasing Agreement is a legally binding agreement between the purchaser (“Customer”) and PersonalHour® (“Company”). By placing an order, completing a purchase, accepting delivery, assembling, installing, or using any PersonalHour® product, the Customer confirms that they have read, understood, and agreed to this Agreement, including the Shipping Policy, Cancellation Policy, Return Policy, and Warranty Terms.

Important: PersonalHour® products are professional fitness equipment. Customer use, setup, maintenance, supervision, and safety are the responsibility of the Customer after purchase and delivery.
1. Order Acceptance and Final Sale Terms

All orders are subject to acceptance by PersonalHour®. Once an order is placed, the Customer agrees that the purchase is final and binding, except only as expressly allowed under the Company’s written cancellation or return policies.

The Customer is responsible for reviewing product dimensions, specifications, features, color, configuration, shipping method, delivery requirements, and all applicable policies before purchasing. PersonalHour® is not responsible for misunderstandings, assumptions, space limitations, access limitations, or failure to review product details before purchase.

2. Product Use and Customer Responsibility

PersonalHour® products must be used only as intended and in accordance with all instructions, safety guidance, setup materials, maintenance guidance, and professional recommendations.

The Customer assumes full responsibility for proper assembly, installation, placement, inspection, maintenance, use, storage, and supervision of the product. Improper use, misuse, neglect, overloading, unsafe movement, unauthorized repair, unauthorized modification, or failure to follow instructions may void warranty coverage and may result in denial of claims.

3. Health, Fitness, and Safety Disclaimer

PersonalHour® does not provide medical advice, physical therapy, diagnosis, treatment, or guarantees of fitness results. Customers should consult a qualified medical or fitness professional before beginning any exercise program, especially if pregnant, injured, recovering from surgery, managing back pain, or living with a medical condition.

To the fullest extent permitted by law, the Customer accepts all risks associated with exercise, equipment use, and physical activity.

4. No Guarantee of Results

PersonalHour® makes no promise or guarantee regarding weight loss, strength, flexibility, rehabilitation, body transformation, pain reduction, or any specific physical outcome. Results vary based on the individual, consistency, instruction, health condition, and safe use.

5. Shipping, Delivery, and Inspection

Shipping, delivery, appointment scheduling, carrier handling, transit timing, and inspection procedures are governed by the Company’s Shipping Policy. Delivery dates are estimates unless expressly stated otherwise in writing.

The Customer agrees to accept delivery and not refuse a shipment except where required by law or expressly approved in writing by PersonalHour®. Refused, missed, delayed, or rescheduled deliveries may result in storage fees, return freight, redelivery fees, cancellation fees, and other costs charged to the Customer.

The Customer must inspect the shipment and report any damage, missing items, or delivery concerns within the timelines stated in the Shipping Policy. Failure to report within the required timeline may be treated as acceptance of the product in delivered condition.

6. Damage, Defects, and Claim Resolution

All claims are subject to review, documentation, verification, and the applicable policy terms. Shipping damage, cosmetic imperfections, transit issues, setup issues, improper use, or maintenance-related concerns do not automatically qualify as manufacturing defects.

PersonalHour® reserves the right to determine the appropriate resolution, which may include replacement parts, repair guidance, service support, partial compensation, or another reasonable remedy, subject to applicable law and written policy terms.

7. Returns, Cancellations, Fees, and Refunds

All returns and cancellations are governed by the Company’s written Cancellation Policy and Return Policy. Approved refunds may be reduced by all applicable costs incurred by the Company, including but not limited to payment processing fees, outbound shipping, return shipping, freight charges, storage, inspection, repacking, restocking, installation coordination, third-party service fees, and any non-recoverable costs.

Unless required by law or expressly approved in writing by PersonalHour®, shipping costs, return costs, service costs, and third-party charges are the Customer’s responsibility.

8. Limitation of Liability

To the fullest extent permitted by law, PersonalHour®, its owners, employees, contractors, affiliates, suppliers, and partners shall not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of income, loss of business, loss of use, inconvenience, emotional distress, personal training costs, assembly costs, installation costs, storage fees, or third-party service costs.

To the fullest extent permitted by law, PersonalHour® shall not be responsible for injuries, losses, damages, or expenses caused by improper assembly, improper installation, improper use, misuse, failure to follow instructions, lack of maintenance, unauthorized modification, unsafe environment, third-party handling, carrier handling, or actions outside the Company’s control.

Where liability cannot legally be excluded, the Company’s total liability shall be limited to the lesser of the amount paid by the Customer for the specific product giving rise to the claim or the minimum amount required by applicable law.

9. Indemnification

The Customer agrees to defend, indemnify, and hold harmless PersonalHour®, its owners, employees, contractors, affiliates, suppliers, and partners from any claims, damages, losses, liabilities, costs, or expenses arising from improper use, unsafe use, unauthorized modification, failure to follow instructions, violation of this Agreement, or use of the product by any person after delivery.

10. Chargebacks and Good Faith Resolution

The Customer agrees to contact PersonalHour® and allow a reasonable opportunity for good faith resolution before initiating a payment dispute or chargeback. Unjustified chargebacks, false claims, or failure to follow policy procedures may result in recovery of fees, denial of future service, and other remedies available under law.

11. Dispute Resolution and Governing Law

To the fullest extent permitted by law, any dispute arising from the purchase, delivery, ownership, or use of a PersonalHour® product shall be governed by the laws of the State of Ohio, without regard to conflict-of-law rules.

Any dispute shall first be addressed through good faith communication with PersonalHour®. If unresolved, the dispute may be handled through binding arbitration in Ohio, unless prohibited by applicable law. The Customer waives participation in class actions and jury trials to the fullest extent permitted by law.

12. Reservation of Rights

PersonalHour® reserves the right to enforce all policy terms, deny unsupported claims, refuse service in cases of abuse or fraud, correct errors, update policies, and protect its business, team, customers, brand, and products to the fullest extent permitted by law.

13. Entire Agreement

This Agreement, together with the Company’s Shipping Policy, Cancellation Policy, Return Policy, Warranty Terms, product pages, invoices, and written order communications, forms the entire agreement between the Customer and PersonalHour®. It supersedes prior verbal statements, assumptions, or informal communications unless confirmed in writing by an authorized Company representative.
